These Terms and Conditions apply to all Bright Tsar Studios (“the Company”, “BTS”) podcast production services. By accepting a quote or invoice, making a payment, or booking a podcast session, the client (“the Client”) agrees to the terms set out below.
Services and scope
BTS provides professional podcast production services across two parts:
- Studio hire — studio time, filming and multi-camera recording, and professional audio capture. On its own, studio hire delivers RAW files (see Revisions and packages below).
- Post-production — editing, syncing, colour grading, mixing and mastering, plus delivery of finished podcast episodes and social media snippets, billed per deliverable as agreed in writing.
Specific services, deliverables, dates and fees for each project are set out in an accepted quote or invoice issued by the Company. Indicative pricing can be explored using the BTS planner at — figures there are a guide only, and final fees are confirmed in writing in your accepted quote or invoice.
Any additional services, overtime, extra revisions, extra promo clips, or add-ons outside the original scope will incur additional fees. These will be discussed with the Client and confirmed via updated quote or written approval before extra work is carried out.
Conduct
The Client must treat all BTS staff, contractors, and any other studio users with respect and professionalism and must not engage in abusive, harassing, or disruptive behaviour. The Company reserves the right to stop a session or refuse future bookings in cases of serious misconduct.
Payment and refunds
Payment is structured in two parts, matching the two parts of the service.
1. Studio hire (session fee).
- The full studio hire fee is paid up front to secure your studio booking and recording date.
- Of this amount, 50% is treated as a non-refundable booking deposit. The remaining 50% is refundable if you cancel with sufficient notice (see Rescheduling and cancellations below).
2. Post-production (editing and deliverables).
- Post-production is billed per deliverable (per episode, per snippet, or per finished minute of long-form video) as each piece is produced and approved.
- These fees are invoiced as the work is scheduled or delivered, per your accepted quote.
Deliverables gate. BTS will not release final high-resolution assets (final audio exports, 4K or MASTERED video files, or RAW files) until the relevant balance, including any agreed out-of-scope additions, has been paid in full. Low-resolution review drafts will be provided in the interim where applicable.
Payment plans. Any alternative payment arrangement must be agreed in writing before work starts.
Rescheduling and cancellations
Notice period: we require a minimum of 48 hours’ written notice to reschedule or cancel a confirmed podcast session.
Reschedule with 48 hours’ notice or more: your full studio hire payment rolls over to the new agreed date at no additional cost.
Cancel with 48 hours’ notice or more: the 50% booking deposit is forfeited, and the remaining 50% of the studio hire fee is refunded.
Cancel or reschedule within 48 hours of the session, or no-show: the full studio hire fee is forfeited, as that studio slot can no longer be reallocated. A new booking and payment are required to secure another date.
Company rescheduling: in the unlikely event that BTS needs to reschedule due to illness or an emergency, we will provide as much notice as possible and secure a new date at no additional cost to the Client.
Timeline and workflow
Podcast production follows the Company’s structured delivery timeline and workflow, as outlined in the latest version of the workflow documentation provided to the Client. This process may be updated from time to time to reflect improvements, and BTS will notify the Client of any key changes relevant to their project.
Delivery timelines (indicative). Target turnaround for a finished (MASTERED) podcast episode is approximately 10 business days from the filming date. Social media snippets are produced from the finalised, approved episode, with a target of approximately 5 business days after sign-off and payment for that episode. Business days exclude weekends and Western Australian public holidays. These are targets rather than guarantees: the clock starts once the relevant balance is paid, and pauses while BTS is awaiting Client feedback, approvals, or outstanding payment.
Revisions and packages
All projects are delivered as one of two file categories, RAW or MASTERED. A plain-English explanation of the difference (formats, what’s included, and visual examples) is provided to every Client here: RAW vs Mastered · Bright Tsar Studios
- MASTERED (studio hire + post-production): fully edited, synced and colour-graded content, ready to publish. Includes up to two (2) rounds of revision per edit. Any additional revisions, extra promo clips, late changes, or overtime will be billed at the Company’s current published rates per edit.
- RAW (studio hire / dry hire): unedited camera angles and audio files provided as-is, for Clients handling their own post-production. No revisions are included. Any later changes or edits will be quoted and billed separately.
If the Client requests changes outside the included revisions or their file category, the Company will provide a quote or rate before proceeding.
Storage and retention
Content is retained by BTS for 3 months during active engagement, then 30 days after offboarding, unless otherwise arranged. RAW and final files are made available for download once the relevant balance is paid in full, and the download window remains open for at least 7 days from the date of release. Longer retention or bulk download requests may incur costs.
Intellectual property
Upon full payment of all amounts due for a project, the Client will own the final delivered podcast episodes and agreed final exports. BTS retains ownership of its methods, production processes, templates, presets, project files, and raw footage or audio unless otherwise agreed in writing. The Company may request permission to use excerpts of the Client’s podcast and related materials for its portfolio, showreels, social media, or marketing. Such use will only occur with the Client’s consent, which may be given in the main agreement, by email, or in writing.
Confidentiality and communication
Both parties agree to keep confidential any sensitive information, trade secrets, or business information disclosed in the course of the project, except where disclosure is required by law. All formal approvals and key communications (including feedback and sign-offs) must be provided in writing, such as by email, messaging apps, or approved review platforms.
Liability
To the maximum extent permitted by law, the Company is not liable for any indirect, consequential, or special loss or damage (including loss of profits, business, or data) arising out of or in connection with the services. The Company’s total aggregate liability arising under or in connection with a project is limited to the total fees paid by the Client for that project.
Force majeure
Neither party is liable for delay or failure to perform their obligations (other than payment obligations) where the delay or failure is caused by events beyond their reasonable control, including but not limited to natural disasters, government restrictions, major technical outages, or other force majeure events. In such cases, timeframes and bookings will be adjusted in good faith where reasonably required.
Term and termination
These Podcast Terms and Conditions govern all podcast production services provided by the Company to the Client unless replaced by a later written agreement. Either party may terminate an ongoing arrangement by giving 30 days’ written notice. Any work completed, booked sessions, or costs incurred up to the effective date of termination remain payable by the Client.
Governing law and dispute resolution
These Terms and Conditions are governed by the laws of Western Australia. If a dispute arises, the parties agree to first attempt to resolve it in good faith through negotiation, and if unresolved, through mediation or arbitration. The prevailing party in any formal dispute resolution process may be entitled to recover reasonable legal costs.
Entire agreement
These Terms and Conditions, together with any accepted quote, invoice, or written agreement, constitute the entire agreement between the parties in relation to podcast production services and supersede all prior discussions or understandings regarding those services, unless otherwise agreed in writing.
